Columbus Marion Phelps was born in 1838 in Warren County, Kentucky. He was the son of David D Phelps and Matilda Allcock. Columbus Marion Phelps married Elizabeth Hudson on 8 November 1860 in Sumner County, Tennessee, according to the forms of the Methodist Episcopal Church South, in Gallatin, Tennessee. Columbus Marion Phelps married Jane Catherine Hudson in 1879. Jane was the sister of Elizabeth. Columbus and Jane had one child named Ellen Phelps who was born in 1880 and died in 1978 in Carmi in White County, Illinois.
On 29 April 1895 Columbus shot and killed his half-brother Henry Phelps. Several years earlier Ras Phelps, a son of Columbus, had stolen a horse from Henry and then left the county. Two weeks prior Jas had been found in Oklahoma and had been brought back to answer for his crime. According to witnesses Columbus came to Henry's house with a gun on his shoulder and asked to see Henry. He told Henry he would give him $30 and a horse if he would testify so as to acquit his son. Henry replied that he would see about it and Columbus fired a load of shot into his side. Columbus then walked away and later surrendered to the Sheriff. He was indited for murder the following day and assigned Public Counsel.
A Jury was impaneled on 14 May 1895 and Columbus was found guilty and sentenced to death on20 May 1895. The Court also ruled that the hanging was to take place in the presence of not more than 50 witnesses. After several unsuccessful appeals a hanging date was set for 8 November 1895.
Ras was tried for the horse stealing charge by Jury on 27 May 1895, pleaded not guilty, and was found not guilty by the jury.
On 20 November 1895 Governor Brown, the Governor of Kentucky, commuted the hanging sentence to life imprisonment. The petition to the Governor had been signed by many reputable citizens of Warren County. Columbus remained in Eddyville Prison in Lyon County, Kentucky for the remainder of his life.

Evidence presented indicated that she had been of unsound mind for five years, had no real estate or personal property other than two cows, one hog, some chickens, and household property. She had showed signs of insanity by quarelling and attempting to fight-worse than ususal, having lucid intervals of 2 or 3 weeks at a time. Mrs. Emily Phelps told the jury that Martha had left her husband Albert Bayless and took notion that her baby was dead but the baby was alive. she said that Martha had attempted to kill the child. The judge ruled that Martha was indeed a Lunitic and that she be carried to the Lunitic Assylum at Hopkinsville Kentucky and kept ther until duly discharged. He appointed two guards to carry her to the Assylium - Levy Bayless her son and James A McGinnis. She was committed to the Assylum on 27 August 1879 where she reamined until her death.
